Arovast Corporation is an ecommerce retailer servingcustomers in areas such as health and fitness devices, home improvement devices,consumer electronics, smart household devices, outdoor recreational equipment,and beauty electronics products. Arovast Corporation (referred to in thispolicy as “Arovast,” “we,” “us,” or “our”) is committed to respecting yourprivacy. Therefore, Arovast wrote thisprivacy policy to describe the types of personal information we may collectfrom you or that you may provide to us, how we use your personal information,how we protect it, when we may disclose it, and how we afford you rightsregarding your personal information.

 

This policy applies to information we collect:

·        On our website.

·        When we use phone, email, postal mail, textmessages, or other forms of electronic communication to communicate with you.

·        When you access and post information on our socialmedia sites.

 

Arovast brands have social media accounts on LinkedIn,Facebook, and Twitter. 

 

If youare located in a member state of the European Economic Area (“EEA”), you mayhave different rights stated here.

 

 

2.  ApplicationPartners’ Mobile Applications

 

Arovast works together and has a business partnership withvarious mobile application developers. Arovastapplication partners include Vesync Corporation (“Vesync”). These application partners are affiliates of Arovast,and as such, they collaborate with Arovast concerning mobile applications tocontrol and manage certain smart device products provided by Arovast. In specific, Arovast does not manage onlineaccounts or the mobile applications allowing users to view and manage thepersonal information collected from Arovast smart devices. Instead, Arovast has arranged for mobileapplication partners such as Vesync to collect and maintain such personalinformation, and users can view and manage the personal information from theirmobile devices using a mobile application from one of Arovast’s applicationpartners.

 

This privacy policy does not govern applications of anyapplication partners. Instead,application partners have their own privacy policy governing the use of itsapplications. Please refer to ourapplication partners’ privacy policies if you have questions about how their mobileapplications collect, use, disclose, protect, and manage your personalinformation. However, to the extent thata mobile application partner collects and maintains personal informationcollected from Arovast smart devices as part of its arrangement with Arovast,this privacy policy discloses Arovast’s policies and practices relating to suchpersonal information. Moreover, Arovastrequires its application partners to meet the standards in this privacy policy.

 

3.  Use by Children

 

3.1.Marketingand Sales to Adults

We market and sell our electronic products to adults 18years and older.

 

3.2.PersonalInformation of Children Collected in Connection with the Use of Our Products

Although we market and sell our electronic products toadults, we recognize that family and household members of purchasers using ourproducts may be children. Onlineaccounts maintained by an application partner used by adult purchasers of ourproducts to review personal information collected via these products mayinclude personal information of purchasers’ family and household members who arechildren. The Arovast products andservices covered by this Section 3.2 are those associated with an applicationpartner online account that collects a child’s name and other personalinformation in connection with the use of the product. Users access their online accounts using anapplication partner’s mobile application.

 

This section describes the following aspects of personalinformation collected from children in connection with the use of productscovered by this section:

·        The types of personal information collected

·        How Arovast and its mobile applications partnerscollect that personal information

·        Uses of the collected personal information

·        The disclosure and sharing of personalinformation with third parties and the role of third parties in maintaining thepersonal information

·        A description of the rights of parents andguardians with respect to personal information collected from their children

·        How parents and guardians can exercise theirrights

 

3.2.1.  Types of Personal Information Collected fromChildren

Arovast’s smart devices maycollect personal information, such as weight, blood, pressure, and fitnessinformation, when children use them. Applicationpartner online accounts may include a child’s name associated with personalinformation collected by smart devices.

3.2.2.  How Arovast and its Application Partners CollectPersonal Information from Children

Arovast smart devices thatcollect personal information use sensors to collect the information. When children are using these smart devices, anapplication partner receives, stores, and maintains their personalinformation. Users may view and managethe collected personal information using an application partner’s onlineaccount accessed via an application partner’s mobile application.

Application partners may alsocollect personal information about children (such as the child’s name) whenparents or guardians provide the information to an application partner usingtheir online accounts accessed via an application partner’s mobile application.

The application partner willobtain verifiable consent before collecting personal information aboutchildren. For instance, when a parent orguardian adds a child to an online account, the parent or guardian must consentto the collection of personal information about the child.

3.2.3.  Usesof Personal Information Collected from Children

Application partners usepersonal information we collect from children for the purpose of providing,maintaining, and supporting their services to allow users to view and managethe collected personal information using an application partner online account.

3.2.4.  Third Party Disclosure, Sharing, and Maintenance

Our policies and practicesconcerning third party personal information sharing, disclosure, andmaintenance are described below in Section 6. These policies and practices apply to personal information collected by applicationpartners from children.

3.2.5.  Retention of Children’s Personal Information

Our policies and practicesconcerning retention of personal information are described below in Section5.5. These policies and practices applyto personal information collected from children maintained by applicationpartners.

   3.2.6.  Parents’ and Guardians’ Rights with Respect toTheir Children’s Personal Information

Parents and guardians have thefollowing rights under this policy with respect to their children’s personal information:

Arovast requires that applicationpartners provide these rights to users of application partners’ mobile applications.

If you revoke permission tocollect a child’s personal information or delete a child’s personal information,your child will not be able to use the functionality of our smart devices.

Please keep in mind that inunusual circumstances we may have a legal right or obligation to preserve achild’s personal information as it currently exists. If we do not amend or delete personalinformation about your child upon your request, we will communicate with youconcerning the reason.

3.2.7.  How Parents and Guardians Can Exercise TheirRights.

If you are a parent or guardian and would like to exerciseany of the rights described in Section 3.2.7, as an Arovast customer and an applicationpartner mobile application user, you have the ability to log into an applicationpartner’s mobile application and make corrections to or delete the personalinformation about your children in your account profile. Alternatively, or if you need assistance,please contact us by one if the means described in Section 11, and someone onour or the applicable application partner’s support team will assist youcorrect, update, or delete your child’s personal information. 

When a parent or guardian seeksto exercise any of the rights in Section 3.2.6, we or the applicable applicationpartner will verify the identity of the parent or guardian. See Section 9.2 for identity verificationdetails.


3.3.OtherCollection of Personal Information from Children

Except as noted above in thisSection 3, we do not provide products or services to children, and we do notknowingly collect personal information from children.


Should a parent or guardianhave reasons to believe that a minor has provided Arovast with personalinformation without prior consent or that we have collected personalinformation about a minor in a way not permitted in this Section 3, pleasecontact us to ensure that the personal information is removed using the contactinformation in Section 11. Also, pleasecontact us if you have any questions or concerns about our collection andmanagement of children’s personal information.


4.  Personal InformationWe Collect

 

Arovast collects information from those who communicate withus, website visitors, and (together with an application partner) from websitevisitors that become customers. Arovastalso collects information from its social media pages.

 

4.1.InformationCollected Via Communications

We may collect information fromindividuals that submit information to us using phone, email, live chat, andpostal mail, including name, phone number, email address, postal address, and voiceor message content.


4.2.InformationCollected from Website Visitors

Arovast collects somecategories of information from website visitors automatically, as described inthis section.

We may collect the followinginformation about website visitors (on an aggregate or individual basis):

·        TheMAC address of visitors’ devices

We maintain records of thoseinterested in our company who use the live chat feature on the website tocommunicate with us.

We use Google Analytics, whichis a service of Google LLC. Google Analytics allows us to gather the aboveinformation about our website’s users.

4.2.2.  Cookie Policy

Cookies may be automatically used tocollect specific information from a computer or mobile device that accesses andnavigates through the Arovast website over time. Information collected by cookies may includeinformation to help improve and customize the content or layout of the website.

 

A cookie is a small text file thatwebsites save on a computer’s storage device when a website is visited. Cookies cannot be used to run programs ordeliver viruses to the computer or mobile device accessing the Arovastwebsite. Users can establish or changetheir browser settings to refuse cookies. Nonetheless, refusing cookies may interfere with the full functionalityof the website and limit the user experience.

4.3.InformationCollected from Users and User Devices


4.3.1.  Information Collected in Connection withPurchases

When purchasing products, we ask customers to provide thefollowing categories of personal information for their account profile on Arovast’swebsite:

·        First and last name

·        Mobile number

·        Email address

·        A user-selected password

·        Postal address (shipping and billing)

·        Payment information

·        Date of birth

 

We maintain a purchase historyof the products you have purchased.

Our electronic commerce sitecollects payment card or banking information to complete productpurchases. Nonetheless, payments areprocessed by or payment service provider, PayPal, and Stripe. Accordingly, we do not have access to yourpayment card information.

When creating a profile, we mayalso ask if you would like to receive our newsletter and other marketingcommunications. If you check the box toreceive such communications, we use the email address in your user profile tosend these communications.

4.3.2.  UserData

When you seek support from usor when you contact us, we may collect your IP address, your locationinformation, such as longitude and latitude, time zone settings, region,country, etc. We also collectinformation about the history of operation of the smart devices you purchasefrom us, including errors, history of logging in, your schedule settings, andinput records. We may also collect technicalinformation to help us identify your device for diagnostic purposes and fraudprevention.

We may also collect otherpersonal information when you use a device or an application partner’s servicesin ways that we describe at the point of collection or otherwise with yourseparate consent when required, such as environmental characteristics value(ECV).


4.4.InformationCollected Via Our Social Media Pages

When you post information on our social media pages on oneof the social media platforms, we will be able to view the content in your post(e.g., text, photo, audio, or video). Wewill also be able to view your username and information that you record on yourprofile on that platform.

 

5.  Personal InformationUses

 

We may use any anonymized or aggregateddata that incorporates or is derived from your personal information (which isnot itself personal information) after you update or delete it; however, wewill not do so in a way that identifies you personally. Otherwise, this section describes the usesfor the personal information we collect.

 

5.1.Uses ofInformation Collected Via Communications

We use personal information inyour communications to communicate with you and respond to your requests,comments, or questions.


5.2.Usesof Information Collected from Website Visitors

We use information collectedfrom website visitors to:

5.3.Uses ofInformation Collected from Users and User Devices


5.3.1.  Usesof Information Collected in Connection with Purchases

We use contact information andpayment information you provide on our electronic commerce website to provideyou the products you order, obtain payment for our products, and providecustomer support. For website account information,the applicable application partner uses your email address and password toprovide and control access to your online account. The application partner’s support team mayassist you by resetting your password or updating your profile information.

If you have opted to receiveour newsletter and other periodic email communications, we will send you ournewsletter and other marketing communications. Also, we track purchase history to understand our customers’preferences, plan for future sales, and understand overall demand for ourproducts.

5.3.2.  Uses of User Data

The applicable applicationpartner collects device data to register your device for its services, toprovide the application partner’s services, and for internal purposes such asauditing, data analysis, loss prevention, and fraud prevention. Arovast and application partners also usedevice data to provide, maintain, develop, operate, deliver, and improve ourproducts and services provided to you. Theapplication partner will access customer data you store in the applicationpartner’s service only on a “need to know” basis, for instance to respond toyour support requests or to respond to a security incident.

When user obtains support fromus, we may use your Internet Protocol (IP) address in order to determinewhether your smart device is functioning properly and to provide usersupport. Likewise, we use your locationinformation, such as longitude and latitude, time zone settings, region,country, etc., as well as the history of operation of the Arovast smart devicesyou purchase, including errors, history of logging in, your schedule settings,and input records, for purposes of user support. We may also collect technical information tohelp us identify your device for diagnostic purposes and fraud prevention.


5.4.Uses ofInformation Collected Via Our Social Media Pages

We use the information you post on our social media pagesand your profile information to understand the preferences of our customersrelated to our current and future product lines. We also analyze feedback on the quality ofour products and related services to improve our products. We are also interested in requests for futureproducts.

 

5.5.Retentionof Personal Information

Arovast and its application partners will maintain yourpersonal information only as long as it is needed for the purposes describedabove in this Section 5, such as to complete transactions with you, to completeany applicable investigations, for the duration of any dispute resolutionprocess, or to the extent required to meet preservation requirements underapplicable law. Arovast and its applicationpartners may continue to maintain your personal information for the reasonsdescribed in Section 7.1.2.2 below.

 

You may delete your online account with an applicationpartner at any time. After you deleteyour online account, the application partner will delete the personalinformation stored in it, including any stored payment information or personalinformation collected by Arovast smart devices.

 

6.  Personal InformationSharing and Disclosures

 

Arovastmay shareyour personal information with the application partner whose mobile applicationcontrols your smart device, other affiliates, vendors, or outsource serviceproviders that help us provide products and services to our customers, or thatassist with support functions such as marketing, billing, payment card processing,and data analysis. We will require applicationpartners and any other such vendors or service providers to manage yourpersonal information with privacy and security safeguards consistent with thisprivacy policy.

 

For Etekcityproducts that interoperate with other devices and systems, you will receivenotice when information about you might go to third parties, and you will havean opportunity to choose not to share the information. For example, if you want to use Amazon’sAlexa, Arovast or the applicable application partner may notify you beforesharing your data with Amazon.

 

From time to time, we may be required to respond to asubpoena, court order, search warrant, administrative or judicial process,requests by law enforcement agencies, or other requests that we must respond tounder applicable law. We may disclose your personal information in response toany of these requirements. Also, we may disclose your personal information topreserve the security of our website or social media accounts, resolvedisputes, or to assess any possible wrongdoing.

 

We also may share aggregate or anonymous informationcollected about website or social media usage, as long as the information doesnot identify any specific individuals. We may share or transfer personal information about you in connectionwith a merger, acquisition, reorganization, or sale of assets of our business,in the event of bankruptcy, or during the negotiations leading to such anevent.  We will seek assurances from anybuyer that your personal information will be used, shared, maintained, anddisclosed consistent with the terms of this privacy policy.

The table below summarizes the categories of personalinformation Arovast and any application partner collect from Californiaresidents, and the business and commercial purposes for which the categories ofpersonal information will be used and may have been used in the last 12 months. The table applies to any application partnerswhose mobile applications you are using to control and manage Arovast smartdevices.  Arovast and the applicable applicationpartner may have collected any or all of these categories of personalinformation in the last 12 months. Asnoted above, Arovast and its application partners do not sell personalinformation in the ordinary course of business. In addition, Arovast and its application partner have not made any salesof personal information in the past 12 months.

Upon request, we will tell a California resident thecategories and specific pieces of personal information we have collected aboutthat resident in the previous 12 months. In addition, upon request, we will disclose to a California resident:

·        The categories of personal information we havecollected about that California resident.

·        The categories of sources from which the personalinformation is collected.

·        The business or commercial purpose forcollecting that California resident’s personal information.

·        Complete the transaction for which the personalinformation was collected, provide a good or service requested by the Californiaresident, or reasonably anticipated within the context of our ongoing businessrelationship with the California resident, or otherwise perform a contractbetween our business and the California resident.

·        Detect security incidents, protect againstmalicious, deceptive, fraudulent, or illegal activity; or prosecute thoseresponsible for that activity.

·        Conduct solely internal uses that are reasonablyaligned with the expectations of the California resident based on theCalifornia resident’s relationship with us.

·        Comply with a legal obligation.

·        Use the personal information internally, in alawful manner that is compatible with the context in which the Californiaresident provided it.

 

The identity of any personmaking such a request must be verified as a condition of deleting the personalinformation as requested. See

7.1.2.3.     How to Exercise Rights of Access, Portability,or Deletion

If you wish to contact us aboutany of your rights as set out in this Section 7.1.2, all such requests shouldbe submitted to us using the contact information in Section 11. We will use the procedures in Section 9.2(Identity Verification) to verify the identity of the California resident orauthorized agent.

Please note, as mentioned inSections 4.3.2 and 7.1.2 above, information from Arovast’s smart devices ismaintained by an application partner. Arovastdoes not have possession of this information, and you will need to contact the applicableapplication partner to exercise your rights concerning such information

7.1.2.4.     Policy Against Discrimination

Arovast will not discriminate against individual Californiaresidents for exercising any of their rights under the CCPA, including by:

·        Denying goods or services to the Californiaresident;

·        Charging different prices or rates for goods orservices, including through the use of discounts or other benefits or imposingpenalties;

·        Providing a different level or quality of goodsor services; or

·        Suggesting that the California resident willreceive a different price or rate for goods or services or a different level orquality of goods or services,


7.2.Notice toCalifornia Residents Regarding “Do Not Track” Settings

Under California law, onlineservice providers must say in their privacy policies how they respond to “donot track” settings that users can set in their browser software.  Currently, there is no standard governingwhat, if anything, a website operator should do when receiving a “do not track”signal.  


Therefore, Arovast does notcurrently take action in response to a “do not track” browser setting.  Arovast will update this policy in response todevelopments regarding an industry standard concerning do not track settings.


8.  How We Secure PersonalInformation

 

Arovast has an information security program to implementreasonable and appropriate industry-standard security controls to protectpersonal information in its possession. Arovastalso requires application partners and their service providers to implementcontrols that are at least as stringent as the ones Arovast itself uses,consistent with this policy. Arovast’sadministrative, physical, and technical safeguards:

·        Provide assurances of the integrity andconfidentiality of personal information covered by this policy;

·        Protect against reasonably anticipated threatsor hazards to the security or integrity of personal information, andunauthorized uses or disclosures of such personal information; and

·        Facilitate compliance with legal frameworks ofrequirements under applicable data protection laws.

 

One example of a security safeguard we use isencryption. Specifically, our electroniccommerce website uses encrypted communications when it obtains your personalinformation and our payment service receives your payment information tocomplete orders and obtain payment for products you purchase using our website.

 

9.  Exercising YourRights

 

9.1.GeneralPolicy Regarding Exercising Your Rights

If you would like to access personal information we havecollected about you in connection with your purchase of products to correct orupdate it, and you are an Arovast customer, you have the ability to log intoour website and make the corrections to the personal information in youraccount profile. If you would like toaccess personal information maintained by an application partner and one of itsmobile applications to view and manage Arovast smart device information, pleasecontact the application partner directly. Alternatively, or if you need assistance, please contact us by one if themeans described in Section 11, and someone on our support team will assist youcorrect or update your personal information or direct you to the applicationpartner’s privacy team for assistance.

 

Please keep in mind that in unusual circumstances we may havea legal right or obligation to preserve personal information as it currentlyexists. If we do not amend personalinformation about you upon your request, we will communicate with youconcerning the reason.

 

If you wish to opt out of orstop receiving any marketing communications from us, please contact us at oneof the mechanisms listed in Section 11. Anyemail communications from us contain instructions on opting out of furtheremail communications. Nonetheless, evenif you opt out of marketing communications, we will still contact you regardingsupport, administration, and security of our services and products. You can always choose not to provideinformation, though not providing such information may mean that you may beunable to make a purchase or to take advantage of certain features of our products.


9.2.IdentityVerification

Arovast has an obligation to verify the identity of anyindividual or representative seeking to exercise rights under the CaliforniaConsumer Privacy Act (CCPA).

 

For California residents with a password-protected accounton our website, we can verify your identity by having you access your accountand complete a web form to submit a request for your rights or confirm that youmade a request.

 

For California residents that do not have an account on ourwebsite:

  • We will verify your identity in response to a request to exercise your individual rights by requiring that you to provide two pieces of information that we already have on file with you, which may include:
    • Items of contact information, or
    • Content of communications you sent to us.

An authorized agent seeking to exercise rights on behalf ofan individual California resident must prove the agent’s authority either by providing a power of attorney pursuantto Probate Code sections 4121 to 4130 or by:

·        Providing a copy of a writing signed by theresident giving the agent permission to act on the resident’s behalf;

·        Verification of the authorized agent’s ownidentity under the procedures in this section; and/or

·        Communicating with the California residentdirectly to confirm the status of the agent as being authorized to act onbehalf of the resident.

 

We will not provide or delete information as requested if weare unable to verify the identity of the requestor as required above, if anagent cannot prove authority to act on behalf of an individual, or we havereason to believe that the request is fraudulent. We may ask for additional verification if wesuspect fraud, such as a copy of an identification credential from therequestor. We will use any suchadditional information strictly for identity verification purposes, and it willbe deleted following the completion of the verification process. We may, however, retain any informationneeded to comply with the CCPA or other applicable law.
